Hiring rules by market
Data protection, quota rules and automated-decision law are all local. These pages cover the three markets CalHire operates in, with links to the primary sources rather than our summary of them.
Hiring law is local even when your process is not. In the UAE, Emiratization quotas and the PDPL govern private-sector hiring. In India, the DPDP Act 2023 sets consent and notice duties for candidate data. In the United States, federal anti-discrimination law applies everywhere and New York City adds a bias-audit requirement for automated hiring tools. These pages cover what each means in practice.
The three regimes side by side
What actually differs between these markets is not the hiring process but which parts of it are legally constrained, and by what. Each cell below is covered in full on the market page it belongs to.
| Aspect | United Arab Emirates | India | United States |
|---|---|---|---|
| Governs candidate data | Federal personal data protection law | Digital Personal Data Protection Act 2023 — notice, consent, purpose limitation | No single federal statute; a patchwork of state privacy laws |
| Constrains who you may hire | Emiratisation targets by ministerial resolution, with monthly contributions for unmet positions | No hiring quota on private employers | No quotas; federal anti-discrimination law bars disparate treatment and unjustified disparate impact |
| Rules on automated decisions | Handled under the data protection law rather than a dedicated AI statute | Handled under DPDP duties; no dedicated hiring-AI statute | NYC Local Law 144 requires an annual independent bias audit and candidate notice; Colorado SB24-205 adds reasonable-care duties |
| The measure regulators reach for | Quota attainment, reported per establishment | Consent and retention records for candidate data | Adverse impact, commonly screened with the four-fifths rule |
| The defining practical constraint | Nationality is a reporting attribute and must never become a screening one | Applicant volume, which is why institution tier and marks are used as filters at all | Any selection procedure is in scope, whether it is a person, a spreadsheet or a model |
Figures and thresholds in all three markets change by resolution or amendment rather than on a schedule. Treat this as orientation and the primary sources linked from each market page as authority.
Hiring in the United Arab Emirates
Emiratisation quotas with real monthly contributions attached, plus a federal data-protection law. National status is a reporting attribute here, never a screening one.
Hiring in the United States
Federal anti-discrimination law applies everywhere, and a growing set of state and city rules add bias-audit, notice and disclosure duties on top.
Hiring in India
Enormous applicant volume, heavy credential signalling, and a data protection act that changed what consent means for candidate data.
